The CMA has also fined the two companies that settled with GSK £1.5 million and £5.8 million, taking the total fines to £45 million.
Cracking down on these practices is essential to protect consumers, to encourage legitimate business activity that such practices stifle, and to stimulate innovation and growth.
GSK reached out of court settlements with the two companies hoping to introduce generic versions of the drug, delaying the launch of cheaper alternatives until late 2003.
This investigation shows our determination to take enforcement action against illegal anti-competitive practices in sectors big and small.

GlaxoSmithKline Accused of Corruption by China |

2013-07-12 00:00:00 |
SHANGHAI — Chinese investigators said Thursday that executives from GlaxoSmithKline, the British drug giant, had admitted to using bribes, kickbacks and other fraudulent means to bolster drug sales in China.
In the case of GlaxoSmithKline, Chinese investigators seemed to have moved with lightning speed, detaining workers, raiding offices in various cities and then publicizing their findings Thursday.
We have done this in China and found no evidence of bribery or corruption of doctors or government officials.
The authorities said that to “open the sales channel and increase prices” in China, GlaxoSmithKline, also called GSK, had bribed or paid off a wide range of people who could aid the company’s sales operations.
Among other things, the China subsidiary of GlaxoSmithKline “committed crimes” by writing special bills related to the value-added tax and issued fake invoices through travel agencies, officials said. |

GlaxoSmithKline, the British drug company embroiled in bribery scandals in China and Iraq, has been accused of bribing doctors in Poland in the latest corruption furore to hit the business.
In 2012, GSK paid a record $3bn (£1.9bn) in fines to settle claims that bribed US doctors into prescribing antidepressants for non-approved uses.
Poland's fraud squad, the central anti-corruption bureau, on Monday said 13 people had been charged in connection with allegations of doctors being bribed to promote GSK's asthma drug Seretide.
In return for the financial gains the doctors would favour the product proposed by the pharmaceutical company and they prescribed that medicine.
In December, Witty promised that GSK would stop making any payments to doctors. |

Chinese authorities have barred GSK China's Vice President for Finance, British national Steve Nechelput, from leaving the country since late June.
Chinese state television also broadcast an apparent confession by Liang Hong .
China's investigation could expose the company to legal action in the U.K., and possibly the United States, under laws relating to the bribery of foreign public officials.
As Chinese authorities and GlaxoSmithKline reveal new information, here is an overview of the probe, the parties involved and the potential penalties. |

The Glaxo case showed that “an open China is not a lawless one,” Xinhua, the official news agency, said in a commentary.
Many global drug makers used the same Shanghai travel agency that the authorities in the Glaxo case said had altered corporate travel expenses to pay cash bribes.
The verdict indicated that Mr. Reilly could be promptly deported.
ChinaWhys, which specialized in due diligence work, completed an inconclusive preliminary report on the sex video of Mr. Reilly by June 2013 and suggested continuing the inquiry.
The Glaxo case — and sizable fine — represents a setback for the company. |
